Executive Orders, Injuntion Lifted

On May 25, 2018, the Trump administration issued three Executive Orders targeting federal government workers. NAGE, along with 12 other Unions representing federal government employees, filed a lawsuit challenging the Executive Orders. Although the lawsuit was initially successful in enjoining many provisions of the executive orders, the Department of Justice won on appeal when the appellate court determined that the lower court did not have jurisdiction over the claims in July 2019. On October 3, 2019, the Court issued it's mandate, vacating the lower court’s injunction.

In response to the October 3, 2019 decision, NAGE National President David J Holway stated “I am very disappointed with the Court of Appeals’ decision concerning jurisdiction. The Trump Executive Orders violate the law and the Court of Appeals failed to address that issue. NAGE will continue to challenge these unlawful attacks on federal employees’ rights in every possible forum.” 

Agencies are now taking action to attempt to implement the previously enjoined provisions of the Executive Orders. Despite these efforts, NAGE local officials will continue to stand by their bargaining members.
